These Terms govern your use of exoticmiamirental.com and any booking with EMCR – Exotic Miami Car Rental, d/b/a “Exotic Miami Rental.” By using the site or reserving a vehicle, you accept these Terms and the Rental Agreement presented at pickup or electronically. The Rental Agreement controls for rental-specific matters.
Minimum age 21 (or higher if required), valid and unexpired driver’s license recognized in Florida, and satisfaction of verification and insurance requirements. Additional criteria may apply to high-value vehicles.
Reservations are offers until confirmed. We may refuse or cancel for risk, fraud, ineligibility, or availability. A security deposit and valid payment method may be required before delivery/pickup. Prices cover only listed items; taxes, fees, tolls, tickets, extras, fuel, cleaning, and damage are additional.
You agree to pay rental rates; delivery/collection fees; young-driver surcharges (if any); late return fees; excess mileage; tolls (SunPass); parking tickets; traffic citations; administrative fees; refueling; smoking/odor and excessive-cleaning fees; loss-of-use; diminished value; towing/storage; key replacement; and damage as provided in the Rental Agreement.
You must maintain valid insurance meeting Florida minimums and any higher limits we require. Optional protection plans apply only as stated. You are responsible for the vehicle from delivery to return, including collision, theft, vandalism, weather, glass, tires, wheels, interior, and accessories, unless prohibited by law or covered by purchased protection.
No racing, reckless driving, stunts, off-road use, or illegal purposes. No smoking or vaping. No unauthorized drivers. Pets only if permitted and returned clean. Do not tamper with GPS/telematics or tracking/immobilizers. Obey traffic and parking laws. You are responsible for tolls and tickets.
Your confirmation states mileage limits and fuel policy. Return on time, with same fuel level and condition, allowing for ordinary wear. Record pre-existing damage at pickup.
Delivery/collection available in specified zones for fees. Late returns may incur per-hour charges up to an extra day rate plus operational costs.
See your confirmation or Rental Agreement. Some bookings are non-refundable or carry change fees.
We may use professional estimates, OEM rates, or third-party assessments for repairs, loss-of-use, and diminished value. You authorize charges to the card on file for undisputed amounts and deposits to cover anticipated charges.
Vehicles may include GPS tracking, immobilizers, usage/mileage counters, and toll transponders (e.g., SunPass). You consent to collection and use of this data for safety, recovery, billing, and compliance. Tolls and citations may be re-billed with administrative fees.
You are responsible for credentials and activity. Do not scrape, reverse engineer, interfere with functionality, or upload malware. We may suspend access for abuse or security risks.
All content, trademarks, and materials are owned by us or licensors. You receive a limited, revocable, non-transferable license to access the site for personal, non-commercial use related to rentals.
We use third parties for payments, identity checks, analytics, messaging, and other operations. Their terms and privacy policies apply.
Services are provided “as is” and “as available.” To the fullest extent allowed, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. Online availability, pricing, and inventory are not guaranteed.
To the maximum extent permitted, we are not liable for indirect, incidental, punitive, or consequential damages. Our total liability relating to the site or a booking is limited to the amounts you paid for the reservation that gave rise to the claim, excluding pass-through costs like vehicle damage fees.
You agree to defend and indemnify us from claims, damages, losses, and expenses arising from your use of the site or vehicle, breach of these Terms or the Rental Agreement, or violation of law.
Disputes will be resolved by binding individual arbitration under AAA rules in Miami-Dade County, Florida, except you may bring eligible claims in small-claims court. You waive jury trial and class/representative actions. Governed by the Federal Arbitration Act. If a court finds the class-action waiver unenforceable, this section is void and claims proceed in state or federal courts in Miami-Dade County, Florida.
Florida law governs. Subject to Section 18, exclusive venue is Miami-Dade County, Florida.
We may update Terms at any time. Continued use after changes means acceptance.
If a provision is unenforceable, the remainder remains effective. We may assign these Terms. You may not assign without consent. No waiver is valid unless in writing.
